Medical Marijuana Now Possible in Michigan

The voters in the state of Michigan have passed a proposal that would permit the medical use of marijuana for those people suffering from a host of debilitating diseases, including HIV. The day after the election, my clinic received 10 calls from patients who want their prescription. The will have to wait. Much needs to be done before marijuana is available by prescription. The state will have to put a system in place to prescribe, distribute, and monitor users as well as prescribers. But for those who believe medical marijuana should be legal, the passage of Proposal 1 in Michigan is a first step.

The regulatory framework that the State of Michigan is required to put together does not include any state involvement in the distribution of medical cannabis. The only role the state has is creating a governmental framework for the implementation of the legislation. There will not be “prescriptions” until the federal laws change. Now patients can simply get a letter from their doctor saying that they have recommended the use of cannabis in the therapeutic treatment of whatever disease(s) their patient has. No prescription is needed.
